The Labor Code now requires employers to pay for unused rest days owed for work on days off and public holidays when terminating employment
03.10.2024
Amendments have been made to Article 153 of the Russian Labor Code, which deals with the remuneration of labour on days off and non-working public holidays.
Under the new wording, employers will be obliged, when terminating a person’s employment, to pay him or her compensation for unused rest days owed for work on days off or public holidays. The employee must receive the difference between higher rate pay and the standard rate pay which has already been provided. The changes affect all unused compensatory time off which accrued while the person in question worked for the employer.
The new wording also provides that, at the employee’s discretion, compensatory time off may be used within one year of working on a day off or non-working public holiday or added onto leave which is granted during that period.
The new requirement will take effect from 1 March 2025.
