On 10 April 2024, the State Duma approved amendments to Article 152 of the Russian Labor Code. According to the new requirements, the calculation of overtime pay must take into account not only the base salary but also reimbursements and incentive payments. If a current employment contract, internal regulation or another document sets a higher pay than that stipulated in the new version of the Labor Code, no changes will be required.
The amendments were drafted in pursuance of Ruling No. 35-P of the Russian Constitutional Court of 27 June 2023, which stated that the current version of the Labor Code was not in compliance with the Russian Constitution.
Earlier, overtime pay was calculated only with reference to the base salary (rate).
The amendments will take effect on 1 September 2024.
